Townsville QLD Police Child Abuse Processes
Online Police behaviours
Police will often pose as a user in online chat groups and applications and attempt to interact with other users online. Police may then ask a user to share information with them and in return share information themselves to build trust with a user online. Once information has been shared with police in this way, police will use it as evidence to charge you with an online child abuse offence.
These online interactions can often go on for a considerable period of time before police take any action against a user. When police decide to take action and arrest the user, the police will arrive at the users residence with a search warrant for all electronic devices including mobile phones, laptop computers, desktop computers and storage devices such as external hard drives.
In person Police behaviours
In person behaviours are those child abuse offences that relate to direct interaction with a person under 16 years of age. In these circumstances, police will usually be contacted by a third party such as a parent, school counsellor or psychologist with mandatory reporting obligations.
The in person interactions may have occurred many years ago or may have occurred recently. The police have different ways to approach in person child abuse behaviours.
The police may conduct what is referred to as a pretext telephone call. This is where the police ask the child – who may now be an adult – to telephone you and try to talk about the child abuse behaviours in an attempt to have you admit your behaviour. This telephone conversation is then recorded and used against you as evidence in court.
Alternatively, police may contact you and ask you to attend a police station to discuss a matter. Or the police may simply come to your address, knock on your door, and ask to speak with you.
What should I do?
You should contact a child abuse defence lawyer as soon as possible. If police arrive at your home with a search warrant, they are required to give you the opportunity to contact a lawyer. Take that opportunity to call a child abuse defence lawyer immediately.
If police call you to ask you to come to the station, or attend your home and want to discuss a matter with you, inform the police that you are happy to speak with them after you speak with you child abuse defence lawyer.
Why do I need a Townsville QLD based child abuse defence lawyer/solicitor?
Child abuse offences are different to other offences. They contain difficult and sensitive matters that require a lawyer who takes a different approach and has a particular skill set. For those who wish to plead guilty to child abuse offences, there are important psychological interventions that can assist you in the sentencing process.
For those who wish to plead not guilty, there are important strategic decisions that need to be made at an early stage. These early decisions may be the difference between a successful defence of the allegations or a conviction after a trial.
